By accessing the website, submitting an order, or purchasing a product, you agree to these Terms and Conditions. Do not use the website or place an order if you do not agree to these Terms.

2. Adult-Only Website and Products
Smoke Stop sells age-restricted tobacco products.
You may only use this website to purchase tobacco products if:
- You have reached the minimum legal age to purchase and possess tobacco in your province or territory
- You have the legal capacity to enter into a binding agreement
- Your purchase, possession, receipt, and use of the products are lawful
- You are purchasing for yourself or for another legally eligible adult
- You are not purchasing on behalf of an underage person
- The shipping and delivery information you provide is complete and accurate
The minimum legal age may differ between provinces and territories. It is your responsibility to comply with the laws that apply at the purchase location, shipping destination, and delivery location.
Smoke Stop may refuse service, cancel an order, request additional information, or restrict access to the website where eligibility cannot be confirmed.
3. Age Verification
Smoke Stop may use one or more age-verification measures before accepting an order or completing delivery.

The person accepting or collecting the package may be required to present valid government-issued photo identification. A package may not be left unattended, placed in a mailbox, or released to an underage person where Proof of Age is required.
An order may be refused, held for pickup, returned, or cancelled if:
- The purchaser’s age cannot be verified
- The recipient does not present acceptable identification
- The recipient does not meet the applicable legal age
- The information provided does not match the order or identification
- The carrier cannot complete the required delivery procedure
Providing false age, identity, billing, or shipping information is prohibited.
4. Permitted Shipping Destinations
Smoke Stop accepts orders only where the sale, shipment, delivery, possession, and receipt of tobacco products are permitted under applicable federal, provincial, territorial, and Indigenous laws, as well as any applicable carrier requirements.
By placing an order, you represent and warrant that:
- You meet the minimum legal age to purchase tobacco products in your province or territory.
- You are legally entitled to purchase, possess, and receive the products ordered.
- The delivery address provided is accurate and located within a jurisdiction where delivery of the products is lawful.
- You are purchasing the products for your own lawful personal use and not for unlawful resale or distribution.
Smoke Stop reserves the right to refuse, restrict, delay, or cancel any order where we believe shipment would not comply with applicable laws, regulations, carrier requirements, or our internal compliance policies.
The availability of a shipping option during checkout does not guarantee that delivery can legally be completed to the destination provided. If an order cannot legally be fulfilled, Smoke Stop may cancel the order and notify the customer accordingly.
5. Indigenous Status, Land, Taxation, and Purchaser Eligibility
Smoke Stop operates from Indigenous land in Ontario. This statement does not mean that every purchaser, transaction, shipment, or product automatically qualifies for an exemption from federal, provincial, territorial, municipal, or other taxes or laws.
Tax treatment and tobacco-sale rules may depend on factors including:
- The seller’s legal status
- The purchaser’s legal or registration status
- The location of the transaction
- The place of delivery
- The product’s manufacture and marking
- Applicable First Nation, federal, provincial, or territorial laws
- Any permits, authorizations, agreements, or exemptions
Customers must not assume that purchasing online or purchasing from a business operating on Indigenous land creates a personal tax exemption or makes possession lawful in their jurisdiction.
Smoke Stop may request information or documentation needed to determine eligibility for a lawful exemption. Smoke Stop may charge, collect, remit, or adjust taxes where required.
6. Product Information
Smoke Stop makes reasonable efforts to provide accurate product names, quantities, packaging details, prices, and images.
Product packaging, health warnings, markings, colours, designs, and other details may change without notice. Images are provided for general reference and may not exactly reflect the product delivered.
Smoke Stop does not warrant that product descriptions, photographs, prices, or other website content are always complete, current, or error-free.
Tobacco products carry serious health risks and may cause addiction, disease, disability, or death. Nothing on the website constitutes medical advice or a statement that any tobacco product is safe or less harmful.
7. Orders
Submitting an order is an offer to purchase and does not create a binding obligation on Smoke Stop until the order has been reviewed and accepted.
Smoke Stop may refuse, limit, place on hold, or cancel an order for reasons including:
- Age-verification concerns
- Payment not being received or confirmed
- Suspected fraud or unlawful activity
- Incorrect pricing or product information
- Product unavailability
- Shipping restrictions
- Carrier limitations
- Quantity limits
- Compliance concerns
- Suspected resale or diversion
- Inaccurate customer information
- An address that cannot be verified or serviced
- Legal or regulatory requirements
Smoke Stop may limit quantities per customer, address, payment source, email address, or household.
8. Payment
Smoke Stop currently accepts payment by Interac e-Transfer.
After placing your order, payment instructions will be provided. Orders are not considered accepted until payment has been successfully received and verified.
Once payment has been confirmed, Smoke Stop will begin processing your order. If we are unable to fulfil your order due to product availability, inventory shortages, pricing errors, or other operational reasons, we will contact you to discuss available options or issue any refund required by applicable law.
Customers are responsible for ensuring that payment information is accurate and that electronic transfers are sent using the instructions provided by Smoke Stop.
Smoke Stop is not responsible for delays resulting from financial institutions, incorrect payment information, failed transfers, security reviews, or circumstances beyond our reasonable control.
9. Prices and Taxes
All prices are displayed in Canadian dollars unless otherwise stated.
Prices, product availability, shipping charges, and applicable taxes may change without notice.
You agree to pay:
- The stated product price
- Applicable shipping and handling charges
- Applicable taxes, duties, levies, or regulatory charges
- Charges associated with a refused, unsuccessful, or returned delivery where permitted by law
If a price or product listing contains an error, Smoke Stop may correct the error and cancel the affected order, even after payment has been submitted. If the order is cancelled solely because of a Smoke Stop pricing or availability error, any payment received for the cancelled item will be addressed in accordance with applicable law.
10. Shipping & Delivery
Smoke Stop currently ships orders within Canada using Canada Post Xpresspost or another available shipping service selected at our discretion.
Orders are generally processed within two to five business days after payment has been confirmed. Processing times may be longer during holidays, periods of high order volume, inventory shortages, severe weather, or circumstances beyond our reasonable control.
Once your order has been shipped, tracking information will be provided where available.
Estimated delivery times are provided by the carrier and are not guaranteed. Smoke Stop is not responsible for shipping delays caused by Canada Post, weather conditions, transportation disruptions, labour interruptions, customs inspections, remote delivery locations, or other events outside our control.
Customers are responsible for monitoring tracking information and ensuring someone legally permitted to receive the shipment is available where required.
Smoke Stop reserves the right to require age verification, proof of identity, or an adult signature before completing delivery where required by law, carrier policy, or our internal compliance procedures.
If a shipment is returned because delivery could not be completed, required identification was not provided, the package was refused, or the shipping information supplied by the customer was inaccurate, Smoke Stop reserves the right to charge additional shipping costs before reshipping the order or to cancel the order where appropriate.
11. Delivery Attempts and Pickup
Customers must monitor tracking information and make reasonable arrangements to receive or collect their orders.
A shipment may be taken to a post office or pickup location when:
- Nobody eligible is available to accept it
- Proof of Age is required
- A signature is required
- The carrier cannot safely complete delivery
- The address or delivery circumstances require pickup
The eligible recipient must bring acceptable identification and collect the package before the carrier’s deadline.
Smoke Stop is not responsible for delays caused by a customer’s failure to monitor tracking, attend delivery, provide identification, or collect a package.
12. Incorrect Addresses
You are responsible for providing a complete and accurate shipping address before submitting an order.
Contact support@smokestop.ca immediately if you notice an error. Smoke Stop cannot guarantee that an address can be changed after payment or order processing begins.
Additional shipping charges may apply where an order is returned or redirected because the customer supplied an incomplete or incorrect address.
13. Lost, Damaged, or Missing Shipments
Customers should inspect their orders promptly after delivery.
Concerns about a missing, damaged, or incorrect shipment must be reported to support@smokestop.ca as soon as reasonably possible. Include:
- Your name
- Order information
- Tracking number
- A description of the issue
- Photographs of the package and contents, where applicable
- Any documentation requested for a carrier investigation
Smoke Stop may require the customer to cooperate with Canada Post or another carrier investigation.
A carrier’s tracking record may be considered evidence of delivery, but it will not override any right or remedy that cannot legally be excluded.
Smoke Stop does not guarantee replacement or reimbursement where a shipment was delivered according to the carrier’s records, collected by an eligible person at the address, refused, abandoned, or not collected before the carrier’s deadline.
14. Returns, Refunds & Order Cancellations
Due to the nature of tobacco products, Smoke Stop does not accept returns or exchanges for products that have been shipped, except where required by applicable law.
Orders may be cancelled before shipment by contacting support@smokestop.ca as soon as possible. Once an order has entered processing or has been transferred to the shipping carrier, cancellation may no longer be possible.
Customers must inspect their shipment promptly upon delivery. If an order arrives damaged, incomplete, or contains an incorrect product, customers should contact Smoke Stop as soon as reasonably possible with photographs and any information reasonably required to investigate the issue.
Smoke Stop reserves the right to determine the appropriate resolution, including replacement, store credit, refund where legally required, or another reasonable remedy.
Refunds will not be issued for:
- Incorrect products selected by the customer.
- Change of mind.
- Failure to collect a shipment.
- Refused deliveries.
- Failure to satisfy age verification requirements.
- Products that have been opened, consumed, or altered after delivery.
Nothing in this section limits any consumer rights that cannot legally be excluded under applicable law.
15. Prohibited Uses
You may not use the website or its products to:
- Purchase tobacco for an underage person
- Misrepresent your age, identity, location, or eligibility
- Evade taxes or legal restrictions
- Purchase products where possession or delivery is unlawful
- Resell, redistribute, export, or divert products unlawfully
- Commit fraud
- Interfere with website security
- Introduce malicious software
- Scrape or copy website content without permission
- Impersonate another person
- Use another person’s payment account without authorization
- Violate applicable law
Smoke Stop may report suspected unlawful activity to relevant authorities.
16. Intellectual Property
Unless otherwise stated, the website’s original text, graphics, logos, layout, design, and other content are owned by or licensed to Smoke Stop.
You may use the website for personal, lawful, non-commercial purposes. You may not reproduce, republish, modify, distribute, sell, or exploit website content without written permission.

Smoke Stop does not guarantee that the website will always be available, uninterrupted, secure, or error-free.

Smoke Stop does not provide medical, health, tax, legal, customs, or regulatory advice through the website.
No statement on the website should be interpreted as suggesting that tobacco use is safe.
Nothing in these Terms excludes a warranty, condition, guarantee, or consumer protection that cannot legally be excluded.
19. Limitation of Liability
To the fullest extent permitted by applicable law, Smoke Stop will not be liable for indirect, incidental, special, punitive, or consequential losses arising from:
- Use or inability to use the website
- Customer misuse of a product
- Tobacco consumption or exposure
- Delivery delays outside Smoke Stop’s reasonable control
- Failure to provide accurate order information
- Failure to meet age-verification requirements
- Unlawful purchase, possession, resale, or transportation
- Third-party websites or services
- Unauthorized access caused by circumstances beyond reasonable safeguards
This limitation does not apply where liability cannot legally be excluded or limited.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold Smoke Stop harmless from claims, losses, liabilities, and reasonable costs arising from:

- Your unlawful use, possession, resale, or distribution of products

The appropriate jurisdiction for a dispute may depend on the parties, the location of the transaction, the delivery destination, applicable consumer-protection laws, and the legal authority governing the seller’s operations.
Nothing in these Terms requires a consumer to waive a legal right to bring a claim in a jurisdiction where such a right cannot be waived.
24. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
25. No Waiver
Smoke Stop’s failure to enforce a provision of these Terms does not waive its right to enforce that provision later.
26. Changes to These Terms
Smoke Stop may update these Terms to reflect changes to its operations, products, shipping practices, service providers, or legal obligations.
The current version will be posted on smokestop.ca with its effective date.
The Terms in effect when an order is accepted will generally apply to that transaction, subject to applicable law.
